The DOI issued two notices on changes to its regulations regarding Workers’ Comp Deductible Policies
The Massachusetts Division of Insurance will be holding two hearings on December 20, 2013 regarding changes that it proposes to its regulations governing Workers’ Compensation Deductible Policies.
First Hearing concerns proposed amendments to Regulation 211 CMR 115.00
The first hearing on changes to the DOI’s workers’ compensation on December 20th will be at 10:00AM concerning proposed amendments to Regulation 211 CMR 115.00. More specifically, the scheduled hearing is to grant the opportunity to all intereted persons to provide oral and/or written comments regarding the proposed amendments to regulation 211 CMR 115.00 entitled Requirements Applicable to Workers’ Compensation Deductible Policies.
“The purpose of the amendments to 211 CMR 115.00 is to regulate the conditions under which insurers offer workers’ compensation deductible plans in Massachusetts, including small, medium and large sized deductible plans. The amendments also combine similar provisions currently found in 211 CMR 113.00, Requirements Regarding Workers’ Compensation Insurance Deductibles, into a single comprehensive regulation governing all workers’ compensation deducible plans, 211 CMR 115.00, Requirements Applicable to Workers’ Compensation Insurance Deductible Plans. The Division’s intent is to promulgate these amendments to 211 CMR 115.00 simultaneously with rescinding 211 CMR 113.00.”
Any one interested in providing oral comment during the scheduled hearing must file a Notice of Intent to Comment with the DOI’s Docket Clerk no later than December 19, 2013 at 4:00pm. Written comments may submitted until the record of the hearing is closed. All submission should be sent to the attention of the Docket Clerk, Hearings and Appeals, Division of Insurance, 1000 Washington Street, Suite 810, Boston, MA 02118-6200, or by electronic mail to Doidocket.Mailbox@state.ma.us and must refer to Docket No. G2013-12 in the subject line. Persons who do not file a Notice of Intent to Comment will be heard after those who notify the Division in advance of the hearing.

The second hearing on changes to the DOI regulations regarding workers’ comp deductibles
The second DOI hearing on December 20, 2013 is scheduled for 10:30AM and involves the proposed repeal of regulation 211 CMR 113.00.
The purpose of this hearing is to afford all interested persons an opportunity to provide oral and/or written comment regarding the proposed repeal of regulation 211 CMR 113.00, Requirements Regarding Workers’ Compensation Insurance Deductibles. The Division proposes to repeal 211 CMR 113.00 contemporaneously with amending 211 CMR 115.00 to incorporate the requirements of 211 CMR 113.00 into the new amended regulation. The amended 211 CMR 115.00, Requirements Applicable to Workers’ Compensation Insurance Deductible Plans, would regulate the conditions under which insurers offer all workers’ compensation deductible plans in Massachusetts, including small, medium and large sized deductible plans.
As outlined above, anyone interested in participating in the hearing by giving oral comment should file a Notice of Intent with the Docket Clerk no later than 4:00pm on December 19, 2013. Again, persons wishing to submit a written comment have until the record of the hearing is closed.
