Three different dockets will be heard during the public hearing
The Massachusetts Division of Insurance has announced that it will be holding a public hearing with regards to three different regulations including Long-Term Care Insurance. The Commissioner of Insurance is granted the authority to hold such hearings pursuant to Massachusetts General Law Chapter 30A.
The scheduled hearing will take place on March 8, 2017 at 10:00 AM in Hearing Room 1-E of the Divisions offices. According to the official Notice of Hearing, the March public hearing will offer interested individuals the opportunity to provide either oral or written testimony concerning three proposed amendments to current regulations. The Division’s descriptions of each of those proposed amendments are reprinted below and are taken directly from the Notice of Hearing:
Docket No. G2017-01: 211 CMR 42.00 Individual Accident and Sickness Insurance
The regulation provides uniform standards for the terms and conditions in individual accident and sickness insurance policies. The proposed amendments conform the regulation to legislative changes to the Massachusetts long-term care statute and to be consistent with proposed changes to the long-term care insurance regulation, 211 CMR 65.00.
Docket No. G2017-02: 211 CMR 55.00 Disclosure Requirements for Life Insurance Policies with Accelerated Benefit Provisions and Annuity Contracts Allowing Early Withdrawal of Proceeds in the Event of Total and Permanent Disability
The proposed amendments conform the regulation to legislative changes to the Massachusetts long-term care statute and to be consistent with proposed changes to the long-term care insurance regulation, 211 CMR 65.00.
Docket No. G2017-03: Long-Term Care Insurance
The Division proposes to amend the long-term care regulation to conform to legislative changes to the enabling statute and to be consistent with the Long-Term Care Insurance Model Regulation developed by the National Association of Insurance Commissioners.
The proposed regulations may be inspected in the Division’s offices during normal business hours or viewed on the Division’s website, www.mass.gov/doi. Persons who wish to present unsworn oral or written statements at the March 8, 2017 hearing are asked to submit a notice of intent to comment no later than March 6, 2017. Other persons who wish to speak will be heard after those who notify the Division in advance. The hearing record will remain open for a week after conclusion of the March 8, 2017 hearing to receive any additional written statements.
How to submit testimony to a Division of Insurance Public Hearing
Any individual who wishes to provide either oral or written testimony concerning this regulation may do so by filing a Notice of Intent with the DOI Docket Clerk no later than March 6, 2017. Please note the Division’s hearing record will remain open for one week after the conclusion of the March 8, 2017 hearing in order to receive any additional written statements.
