An adversary proceeding in bankruptcy is a separate lawsuit filed within a bankruptcy case. In many cases, these lawsuits are filed against the person seeking bankruptcy protection. A creditor may file an adversary proceeding to challenge the discharge in bankruptcy of that creditor’s debt because the debt resulted from the debtor incurring the debt by fraud or because the debtor was a fiduciary who converted funds.« Back to Glossary Index
